Katie Holmes in for very tough child custody fight with Tom Cruise & more. According to a new report from Hollywood Life and their sources, it looks like actress Katie Holmes is going to be in for one hell of a sole custody battle for her daughter Suri in this whole Tom Cruise divorce madness. As previously reported, Katie is trying to get Suri away from all that Scientology wackiness that Tom’s trying to push on her.

However, their lawyer source Vikki Ziegler said, Katie’s in for a pretty tough road with that. First off, Katie filed for divorce in New York because they’re more likely to award sole custody there as opposed to California. However, Tom is going to try and get the case moved to California, where they’re more likely to award joint-custody.

Vikki said, “Katie needs to prove that she has lived full-time in New York City for a year for the divorce to be decided here. The judge will look at what state her driver’s license is registered in, where her taxes are filed, and what’s her main mailing address.”

Also, if the prenup says that the divorce has to be done in California,then they’ll have to do it there. Otherwise, Tom will have to prove that New York was just a temporary residence to have the case moved to California.

After that, Katie has to prove that Tom is an unfit parent. Vikki stated, “maybe she’ll argue that his Scientology beliefs are dangerous for the child, and he’s not capable of making sound decisions on her behalf.”

Or “she can also say that she’s been with the child full-time while he’s been traveling, she’s a better parent, and should have full decision making power over the health, welfare, and education of the child.” Stay tuned.
